Read Our Workers’ Comp FAQ
Injured workers often have questions for our lawyer about their workers’ compensation case. We have provided a list of these frequently asked questions, along with some information that you may find helpful as you deal with your own workplace injuries.
Some of the Nebraska workers’ compensation FAQ we hear at our firm include:
- How do I know if I am getting the right amount of weekly disability? There are specific tools in place to determine the amount of compensation that should be provided to the injured worker. We can analyze your situation to see if your employer is including weeks that should be excluded from the calculation of your average weekly wage.
- What rights do I have if I cannot do jobs for which I have prior education, training or experience? In Nebraska, you are eligible to receive additional training that your employer must pay for if you have been injured while on the job. You may also receive additional compensation due to the loss of earning capacity if you are unable to return to the position that you held prior to injury.
- What rights do I have if I cannot keep working because of age/injury? What rights do I have as an older injured worker? Workers over 50 have a more difficult time adapting after an injury. It can take longer for them to heal, and they may not be able to truly recover from their injuries. Sometimes employers put these employees in a no-win situation, and they struggle to return to the workforce after the incident. A big part of our practice is helping injured workers over 50 deal with workplace injuries.
